There was a water leak at my client’s home caused by pinholes in copper tubing.  The leaks occurred in the crawl space under the floor.  The home was insured at the time of the leak by Nationwide.

My client realized there was a problem when the floors in her home began to sink down and separate from her walls.  She called her homeowners insurer  who sent engineers to investigate the claim.  Based on the engineers’ report, Nationwide denied the claim.  Nationwide relied on the following exclusion:

We do not cover loss to property, described in Coverage A and B, resulting directly from any of the following:

e)  continuous or repeated seepage or leakage of water or steam over a period of time from a heating, air conditioning or automatic fire protective sprinkler system; household appliance; or plumbing system that results in deterioration, rust, mold, or wet or dry rot.

f)  wear and tear, marring, deterioration.

I suspect that neither of these exclusion apply.  The water leak from the plumbing system did not cause “deterioration, rust, mold, or wet or dry rot.”  The water caused the joists in the floor to bend, not deteriorate.  Indeed, the rockers on rocking chairs are made by soaking the wood and bending it.  The wetting of the wood over a relatively short period of time does not cause it to deteriorate, it merely allows you to bend it.

The “wear and tear” exclusion is equally inapplicable.  The damage to the wood joists was not caused by wear and tear.  It was caused by the sudden and accidental release of water – a covered cause of loss.  At best, the insurer could show that the copper pipe leaked because of “wear and tear.”  Thus, the insurer is possible relieved of having to replace the actual piece of copper pipe – it is not relieved of its responsibility of paying for the the resulting damage.

Simply stated, the “wear and tear” exclusion only applies to the item which actually wears out, it does not apply to damage that results from the worn out item.

As with almost all of my insurance cases, in this case my client doesn’t pay me anything. If I win, the insurance company

As the school and university year begins for the current year, it would be helpful to know which of the cars could be a good option for your younger member of the family. UK drivers have been suffering at the hands of increasing insurance premiums in addition to the accidents that have increased overtime to gain insurance claims. Furthermore, it is noted that accidents involving the uninsured motorists can add to the surmounting insurance premiums. Close to 1.5 million drivers in UK ride without insurance cover for their cars and while the same is considered as an illegal practice, there has been no improvement in the same. It would eventually bring forth a situation where attempts to compare car insurance cannot be effective in lowering the premium rates. In accordance with a major insurance name, the premiums have crossed 2009 values by as much as 30%.

On August 10, 2010, the World Health Organization (WHO) announced that we are “now moving into the post-pandemic period.” This comes after fear and panic spread throughout the world since the virus was highly contagious and had unknown effects.

The Emergency Committee of the WHO, which has overseen the spread of the virus, says that while the virus pandemic is over it is possible to see a reemergence as a seasonal influenza virus for years to come. Currently, the Swine Flu is predicted to have “localized outbreaks of different magnitude” like in New Zealand and India. Because we are now armed with the information, in countries like these awareness, vaccination, detection, and treatment is helping to reduce the spread and severity of symptoms. There ar

The car insurance continues to see troubling times with a recent research claiming that UK motorists have been giving up on their savings by agreeing to automatic insurance renewals. The researcher, an insurance mammoth in UK, sees this as a behaviour marked by recklessness, for even with insurance deals available people choose not to compare car insurance. If the motorists choose comparing even in the current downturn, it is likely that they will be able to save £230 in a single year, which is a small amount yet significant.

The research when extended to cover, a greater driving population showed that close to 36% of UK drivers continue to show interest in getting economical insurance policies while the younger drivers have been showing an increased trend to change their insurance providers.
